The developer proposing to build an E-Commerce Center behind Fairway Market with half the building in the Bronx and half in Pelham Manor has submitted paperwork suggesting a Pelham Manor Zoning change that would be required for the building's approval. No zoning change is requiredfor the half of the building in NY City.
Village Manager John Pierpont said at the Village Board of Trustees meeting on Monday, Nov. 11 that the paperwork now will be reviewed by himself, the Village Attorney, Board members and outside counsel and consultants. He noted that the developer has placed in escrow $25,000 to cover costs f such review as well as other costs expected to be related to the project.
Mr. Pierpont said the proposed zoning amendment includes wording on a special permit use, how to issue such a permit and other details. "But there is a long way to go," he added.
A representative of the developer is expected at the Dec. 16 meeting of the Village Board to discuss the issues further.
Also still unresolved is a proposal that New York City would issue the building permit and the certificate of occupancy for an E-Commerce building if it is approved for a site located half in the Bronx and half in Pelham Manor. State law allows one municipality to take the lead in such a circumstance or some shared arrangement.
